    9:00 – 9:10                  Program Overview

     In this introduction, section participants will be provided an overview of the presentation topics, timing, and schedules for the program, attendance requirements for obtaining credit, an overview of the nature of the program as guidance and not legal advice, and how questions will be handled during the programs.

    A comprehensive overview of some major legislative, regulatory and case law developments, including developments at some Massachusetts and Federal agencies, and significant court decisions under Federal and Massachusetts law (NH discussed in the later section).

    This presentation will explore recent trends of the National Labor Relations Board, including such areas as concerted protected activity, workplace policies, and the ever-evolving role of the use of social media as it relates to the workplace.

    In this session, participants will be provided a section by section overview of the new Massachusetts law Massachusetts Noncompetition Agreement Act (M.G.L. c.149, § 24L), which became effective on October 1, 2018.   

    11:15 - 11:35              New:  Mass Family and Medical Leave Law(20 min)                     

    In this session, participants will be provided an overview of the New Massachusetts Family and Medical Leave Law (M.G.L. c. 175M), with a focus upon key dates and the January 2019 Draft Regulations. 

    11:35 – 12:00             New:  Mass Equal Pay Act
    (25 min)                     

    In this session, participants will walk through some key provisions of the New Mass Equal Pay Act, which became effective in 2018.  A majority of this session will focus on the March 2018 Guidance published by the Massachusetts Attorney General’s Office in this area.

    12:00 – 1:00               Lunch and Networking

    1:00 – 1:45                 Lessons from 2018           

    In this section participants will participate in a workshop style discussion which focused on some of the lessons learned from the past year through major case decisions, media focus and/or court focus.  Workshop questions will be in the areas of investigations, whistleblowers, prompting complaints, effective employee education, cultures of secrecy, and steps to consider when trying to promote open reporting versus a culture where fear of retaliation or retribution leave complaints hidden.

    1:45 – 2:00                 Brief Wage and Hour Update
    (15 min)                     

    This section will focus on some hot topics of the past year in the
    Wage and Hour area, which will include some case highlights, an overview of DOL Opinion letters, any Massachusetts opinion letters and any other area of extra interest of focus not previously covered in the program.
