Join us virtually on Friday, March 21, from 9 - 10 am, as attorneys from Jackson Lewis LLP discuss whether, when and how an employer may lawfully request or require doctor’s notes from an employee, including the following instances:
- Medical certifications to determine if a leave is FMLA qualified;
- Requesting a doctor’s note as part of the process of accommodating an employee’s disability under the ADA;
- The permissible use of doctor’s notes to verify an employee’s absence under call-in or call-out policies; and
- The limits of an employer’s ability to require employees to disclose medical information upon returning from sick leave.
- We will also discuss the privacy implications of requesting doctor’s notes and medical records.
